The following is an eviction case out of Ohio brought by the Plaintiff “Hudson Homes Management, LLC” claiming to be both the owner of the property and the agent for the lessor – LSF9 Master Participation Trust. I assisted Defendant’s counsel who, based upon my findings and evidence, filed the following motion to dismiss:
Upon the motion, the Magistrate granted leave for the Plaintiff to file a responsive brief proving its authority and standing to have filed the complaint. As I predicted, Plaintiff failed to file any responsive brief, and failed to produce any evidence in support of it’s standing at the hearing outside of pointing at the county auditor’s website. The Magistrate didn’t buy it. Here is the decision and judgment:

Further confirmation that U.S. Bank Trust, N.A. as Trustee, the LSF9 Master Participation Trust, Hudson Homes Management, LLC, or any combination thereof, do not own the properties they foreclosed upon.
