The administrative process developed by BP Investigative Agency offers clients a pre-litigation alternative to challenge mortgage enforcement. Rooted in statutory law, this process uses UCC 2-609, FDCPA 1692g, TILA, and RESPA to formally demand documentation from servicers and alleged creditors.

This notice strategy places the burden of proof on those claiming enforcement rights. When unanswered or inadequately addressed, these notices are designed to trigger an administrative default by operation of law, consistent with statutory frameworks such as UCC § 2-609 and FDCPA § 1692g. While not equivalent to a judicial ruling, such defaults may carry significant evidentiary weight and serve as a basis for asserting borrower defenses or adverse claims in legal or administrative forums.

This strategy is particularly effective in challenging standing, bifurcated note and mortgage claims, and unverified trust assignments.
