As Predicted, Chase Continues Its Game Of “Whac-A-Mole”

A client of mine from Colorado hired me to investigate his WaMu Deed to which JPMorgan Chase staked its claim and was moving to foreclose. The “Rule 120 Hearing” was scheduled for August 2, 2017. Counsel for my client appeared for the hearing and was prepared to challenge Chase’s position that it was the beneficial owner of the Deed and Note. Here is an email exchange with my client explaining what occurred at that hearing, along with my prediction.

Bill-

I thought perhaps I should bring you abreast of our situation as of today, August 23.

To refresh your memory, on August 2 we had the Rule 120 hearing. Chase attorneys did not attend, and our attorney still entered a challenge to the Riley signature and the DOT assignments.

Judge denied the Chase motion for foreclosure, and dismissed the case.

We received another motion for Rule 120 hearing today, scheduled for 09/20, response by 09/13.

You were right on the button….the new applicant is ‘US Bank Association, solely as trustee for the RMAC Trust 2016-CTT’

If I’ve seen this happen once, I’ve seen it a thousand times.  Forget about 15 U.S. Code § 1641(g), the banks’ playbook is nothing more than an elaborate game of “Whac-A-Mole.” What’s disturbing is the fact that Chase would have likely continued its course had there been no challenge, and would have foreclosed and harvested the property when it belonged to the “RMAC Trust 2016-CTT.” But this assumes the transactions involving the “RMAC Trust 2016-CTT” are legitimate, which I predict were not.
